Welcome to PlastekCards.com (the “Site”). These Terms of Use (“Terms”) govern your access to and use of the website, services, and products provided by Plastek Card Solutions, Inc. (“Plastek Cards,” “we,” “us,” or “our”).

By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.

1. Use of the Site

You may use this Site for lawful purposes only. You agree not to:

Use the Site in any way that violates applicable laws or regulations.
Upload or transmit any viruses, malware, or destructive code.
Attempt to gain unauthorized access to our systems or user accounts.

2. Intellectual Property

All content on this Site, including text, graphics, logos, images, and software, is the property of Plastek Cards or its content suppliers and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from this content without express written permission.

3. User-Provided Artwork and Content

When you upload artwork, logos, or designs (“User Content”) for printing:

Ownership: You represent and warrant that you own the rights to the User Content or have obtained all necessary permissions to use and reproduce it.
Indemnification: You agree to indemnify and hold Plastek Cards harmless from any claims, liabilities, or expenses arising from a third-party claim that your artwork infringes on their intellectual property rights.
Quality: You are responsible for ensuring that artwork meets our “Artwork Guidelines” (e.g., 300 dpi, CMYK color mode, bleed lines). Plastek Cards is not responsible for errors resulting from low-quality or incorrectly formatted files provided by the customer.

4. Orders and Payment

Quotes: Price quotes are valid for the period specified on the quote.
Payment: All orders must be paid in full at the time the order is placed unless otherwise agreed upon in writing. We accept major credit cards and other payment methods as indicated on the Site.
Cancellations: Because our products are custom-manufactured, orders cannot be canceled or modified once they have entered the production phase.

5. Proofing and Production

Proof Approval: We provide a digital proof for your approval before production begins. It is your responsibility to review the proof for spelling, layout, quantity, job specifications, and design accuracy. Your approval of the proof is final.
Color Accuracy: Due to variations in monitor settings and the nature of plastic printing, we cannot guarantee an exact match between the colors on your screen and the final printed product. For critical color matching, please provide Pantone (PMS) colors or physical samples.
Production Time: Turnaround times are estimates and start only after proof approval and payment are received. We are not liable for delays caused by shipping carriers or “Acts of God.”

6. Shipping and Delivery

Risk of loss and title for products pass to you upon delivery to the carrier. We are not responsible for delays, damage, or loss occurring during transit.

7. Refund and Satisfaction Policy

Plastek Cards stands behind the quality of our work.

If there is a manufacturing defect or an error that deviates from your approved proof, please contact us within [7] days of receipt.
We will, at our discretion, replace the defective product, issue a credit, or provide a refund.
We do not offer refunds for errors present in the approved proof or for issues related to customer-provided artwork quality.

8. Limitation of Liability

To the fullest extent permitted by law, Plastek Cards shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of our Site or products, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you for the specific order in question.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use your information.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.

11. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the new Terms.
